Terms of Service

These terms govern your use of zappsy.store and any purchase you make from us. By using this site or placing an order, you agree to them. Please read them before ordering.

1. Who we are

This store is operated by Zappsy. Throughout these terms, "we", "us" and "our" refer to Zappsy. "You" refers to you, the customer.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By ordering you confirm that the information you provide is accurate and that you are authorised to use the payment method you supply.

3. Products and descriptions

We do our best to describe and photograph our products accurately. Colours can vary between screens, and measurements are approximate. Product availability is not guaranteed and we may change or discontinue a product at any time.

4. Pricing

Prices are shown in the currency selected at checkout and include Australian GST where applicable. We reserve the right to correct pricing errors and to change prices at any time before an order is accepted. If we discover a genuine error in the price of something you've ordered, we'll contact you before dispatch and give you the choice of proceeding at the correct price or cancelling for a full refund.

5. Orders and acceptance

Your order is an offer to buy. We accept it when we dispatch the goods and send you a confirmation. We may decline or cancel an order — for example where a product is unavailable, where we suspect fraud, or where we cannot ship to your address. If we cancel an order you've paid for, we'll refund you in full.

6. Shipping and delivery

Delivery times and shipping terms are set out in our Shipping Policy, which forms part of these terms. Delivery estimates are estimates, not guarantees. Risk in the goods passes to you on delivery.

7. Returns and refunds

Returns are governed by our Refund Policy, which forms part of these terms.

8. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law.

9. Product use and safety

Our products are pet accessories, not veterinary or medical devices. Supervise your pet while they are wearing them, introduce them gradually, and stop use if your pet shows signs of discomfort or irritation. They are not a substitute for veterinary care.

10. Accounts

If you create an account, you are responsible for keeping your login details secure and for activity under your account. Tell us immediately if you believe your account has been compromised.

11. Acceptable use

You agree not to use this site for any unlawful purpose, to attempt to gain unauthorised access to it, to interfere with its operation, or to scrape, copy or resell its content without our permission.

12. Intellectual property

All content on this site — text, images, logos and design — is owned by Zappsy or used with permission, and may not be reproduced without written consent.

13. Third-party links and services

This site is hosted by Shopify and may link to third-party sites and services. We are not responsible for the content, policies or practices of third parties.

14. Limitation of liability

To the extent permitted by law, and subject to clause 8, our liability arising from any order is limited to the amount you paid for the goods concerned. We are not liable for indirect or consequential loss.

15. Privacy

Our handling of your personal information is described in our Privacy Policy, which forms part of these terms.

16. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.

17. Governing law

These terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
